1. Introduction

Welcome to costonks ("the App"), a platform enabling users to create portfolios, engage in virtual stock trading, join communities, and interact via posts, links, and images. By accessing or using the App, you agree to these Terms and Conditions ("Terms"). If you disagree with any part of the Terms, you must cease using the App.

2. Eligibility

  1. You must be at least 16 years old to use the App, per GDPR and U.K. Online Safety Standards. Users under 18 must have parental consent where required by applicable laws.
  2. By using the App, you represent and warrant that all registration information you submit is accurate and you comply with these Terms.

3. Privacy and Data Collection

  1. The App collects, processes, and stores personal data in accordance with our Privacy Policy. For users in the EU, we comply with the GDPR, ensuring the lawful basis for data collection and user rights.
  2. User activity, including interactions and portfolio activity, is tracked using Google Analytics. Data collected is anonymized where possible.

4. Virtual Portfolios and Stock Trading

  1. costonks provides a simulated stock-trading experience. No real money transactions occur on the platform. The App is not a financial advisor or brokerage service.
  2. Users can track real stocks and mimic transactions through their own banking or brokerage apps. The App holds no responsibility for accuracy in stock price feeds or financial outcomes resulting from user decisions.
  3. Portfolios marked as "virtual" or "real" are for simulation and tracking purposes only.

5. User Conduct

  1. You agree to use the App lawfully and responsibly. Prohibited activities include:
    • Posting harmful, abusive, or defamatory content.
    • Sharing copyrighted material without proper authorization.
    • Uploading malicious software or spamming.
  2. Content shared in communities is monitored to maintain compliance with U.S. Section 230 of the Communications Decency Act, U.K. Online Safety Act, and EU Digital Services Act.

6. Intellectual Property

  1. All content, trademarks, and intellectual property on the App belong to Costonks or its licensors. Unauthorized reproduction or use is prohibited.
  2. Users retain rights to content they create and share but grant the App a non-exclusive, royalty-free, worldwide license to display, distribute, and promote such content.

7. Limitation of Liability

To the fullest extent permitted by applicable law, costonks and its affiliates, directors, employees, agents, or licensors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or related to:

  • The use of or inability to use the App.
  • Inaccuracies or errors in stock prices, analytics, or other data provided by the App.
  • User-generated content, including breaches of third-party rights, defamatory statements, or illegal activity.
  • Service interruptions, delays, or failures due to technical issues, maintenance, or events beyond Costonks' control.
  • Unauthorized access to or alteration of your data, including security breaches or data loss.
  • Any other matter relating to the App.

costonks provides the App on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the App will be uninterrupted or error-free.

In jurisdictions that do not allow the exclusion or limitation of certain liabilities, costonks' liability shall be limited to the maximum extent permitted by law.

8. Termination

  1. costonks reserves the right to terminate accounts that violate these Terms.
  2. Users who wish to delete their accounts must submit a formal request by contacting hello@costonks.com. Upon receiving the request, costonks will process the account deletion within 60 days in accordance with GDPR and other applicable laws. Certain data may be retained for legal, regulatory, or security purposes where permitted or required by law, but it will no longer be accessible to the user.

9. Governing Law and Dispute Resolution

  1. These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to conflict of law principles.
  2. For users in the U.S., U.K., EU, or other jurisdictions, mandatory consumer protection laws of the user's country of residence may also apply, as required by law.
  3. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Belgium.

10. Modifications to the Terms

costonks reserves the right to update or modify these Terms at any time. Changes will take effect immediately upon being posted within the App or on the associated website. Continued use of the App after such modifications constitutes your acceptance of the updated Terms. It is your responsibility to periodically review these Terms to stay informed of any changes.
